1. Ownership and Agreement

The Website is owned and operated by Fabrica Kraft LLC, based in Dover, Delaware. Any reference to "Cordelia Kraft," "we," "us," or "our" refers to the jewelry brand and its parent entity. By accessing, browsing, or placing an order on this Website, you agree to be bound by these Terms.

2. Handcrafted Jewelry Policy

• Artisanal Nature: All items sold on Cordelia Kraft are handmade. You acknowledge that because these are handcrafted—using natural clay, glass beads, and Sheesham wood—minor variations in color, shape, and texture are inherent to the process and are not considered defects.

• Product Care: Responsibility for the care and longevity of the jewelry lies with the customer once the item is received.

3. Account Eligibility and Security

• Eligibility: Services are intended for adults. We reserve the right to terminate accounts found to be operated by minors.

• Security: You are responsible for maintaining the confidentiality of your account credentials.

4. Orders and Customization

• Placing Orders - We allow you to place orders for the products listed on the website and facilitate the placement of your orders, strictly for commercial purposes and subject to these Terms of Service. Your order on Cordelia Kraft is only an “offer” to buy and shall be subject to confirmation by us. An order once confirmed by us shall be treated as final. Where applicable, the amount of the order may include shipment charges and applicable taxes.

• Order Changes: Because our jewelry is often made-to-order, changes cannot be accepted after 24 hours of order placement. Once the crafting process has begun, no modifications can be made.

5. Return and Cancellation Policy

• Because our jewelry is ready-made (not custom), order cancellation or modification requests may be accepted only before the order has been shipped.

   

• Once an order has shipped, it cannot be modified or canceled and must follow our Returns Policy.

6. Customer Responsibilities

• You agree that:

  • Normal wear, improper care, exposure to water, chemicals, perfumes, or physical damage are not manufacturing defects

  • You will follow care instructions to preserve the quality of the jewelry

• Display Variations: While we provide high-resolution photos, we are not responsible for perceived color differences caused by the customer’s computer monitor or mobile screen settings.

• Inspection: Customers must inspect jewelry for shipping damage immediately upon delivery. Follow the damage reporting procedure found in our Shipping Policy.

7. Cordelia Kraft Responsibilities

We are responsible for:

• Delivering jewelry that matches the product description
• Addressing manufacturing defects reported within the timeframe stated in our Returns Policy

Our liability is limited to repair, replacement, or refund at our discretion.

8. Intellectual Property

• Trademarks: Cordelia Kraft® is a registered trademark. Use of our logos or design elements without express written consent is strictly prohibited.

• The “Cordelia Kraft” name and logo and all related names, design marks and slogans are the trademarks, logos or service marks owned by Fabrica Kraft LLC. 
  

• FabricaKraft  expressly and exclusively reserves all the intellectual property rights in all text, programs, processes, technology, software and other materials, which appear on its website including its looks and feel. The compilation (meaning the collection, arrangement and assembly) of the content on our website is the exclusive property of Fabrica Kraft and is protected by the applicable local laws and international treaties. Consequently, the materials on the website shall not be copied, reproduced, duplicated, republished, downloaded, posted, transmitted, distributed or modified in whole or in part or in any other form whatsoever. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such unauthorised downloading or copying, reproducing, duplicating, republishing, posting, transmitting, distributing or modifying.
  
• Copyright: All jewelry designs, text, and photography on this Website are the exclusive property of Fabrica Kraft LLC and protected by international copyright laws.

9. Payments and Chargebacks

• Advance Payment: Due to the artisanal nature of our jewelry, 100% advance payment is required for all orders.

• Chargebacks: Fraudulent chargebacks (reversing payment for jewelry that was successfully delivered) are considered theft. We will aggressively prosecute and report such activity to the relevant authorities.

10. Shipping Insurance

All jewelry shipments are protected by InsureShield® Shipping Insurance (provided by UPS Capital).

• Coverage: Applies only during transit.

• Claims: Must be processed according to UPS Capital documentation standards.

11. Limitation of Liability

To the fullest extent permitted by law, Cordelia Kraft shall not be liable for any incidental or consequential damages arising from the use of our jewelry. Our total liability shall not exceed the amount paid for the specific item in question.

12. Governing Law and Jurisdiction

• Governing Law - These Terms of Service shall be construed in accordance with the applicable laws of India without regard to the conflict of law principles.
  

• Amicable Negotiations - If any dispute or claim arises from or in connection with (i) these Terms of Service, (ii) any order placed on the website, or (iii) your access to or use of our Services (“Dispute”), the relevant parties shall resolve the Dispute through amicable negotiations.
  

• Disputes between you and FabricaKraft - Any dispute pertaining to the use of the Website or any service incidental to the service, between you and FabricaKraft, or in connection with the validity, interpretation, implementation or alleged breach of any provision of these Terms of Service, shall be referred to the senior management of FabricaKraft for conciliation. If the dispute has not been resolved, then such a dispute shall be subject to the exclusive jurisdiction of the courts in New Delhi, India and you hereby agree to submit to the exclusive jurisdiction of such courts. 

13. ENTIRE AGREEMENT

• If any part of these Terms of Service is determined to be invalid or unenforceable pursuant to the applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms of Service shall continue to be in effect. Unless otherwise specified herein, these Terms of Service constitute the entire agreement between you and FabricaKraft with respect to using / accessing our Website or Services, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written.
  
• FabricaKraft’s failure to act with respect to a breach by you or others does not waive its right to act with respect to the breach or subsequent and similar breaches.

14. General

• You acknowledge and hereby agree to these Terms of Service and that it constitutes the complete and exclusive agreement between you and us concerning your use of Fabrica Kraft, and supersedes and governs all prior proposals, agreements, or other communications.
  
• Nothing contained in these Terms of Service shall be construed as creating any agency, partnership, affiliation, joint venture or other form of joint enterprise between you and us. Our failure to require your performance of any provision hereof shall not affect our full right to require such performance at any time thereafter, nor shall our waiver of a breach of any provision hereof be taken or held to be a waiver of the provision itself. 
  
• The headings in the Terms of Service are for convenience only and shall not be used in its interpretation.

• All shipments are protected by InsureShield® Shipping Insurance provided by UPS Capital, subject to the terms, conditions, limitations, and exclusions of the applicable policy. Coverage applies only during transit and does not replace carrier delivery timelines or service guarantees.
  
• Claims, if any, are processed in accordance with UPS Capital policy requirements and documentation standards. Coverage availability may vary by shipment value, destination, and shipping method.
